Pensions Disputes and Litigation

Pension related disputes can be subject to consideration at several different levels, therefore it is important to ensure that it is dealt with properly at even the least formal level.

To ensure that matters are dealt with at the appropriate level (and, if possible, minimise the potential of the matter escalating to a higher level) and in order to ensure that our clients' cases are effectively advanced at each stage, our lawyers employ their knowledge and practical experience of both pensions law and dispute resolution at all stages of a dispute, even informal complaints.

We can assist in assessing the merits of a complaint or dispute and the appropriate response at each of the following stages:

 

  • An informal complaint: One of our objectives in advising on informal complaints is to prevent as many of them as possible from becoming formal disputes. 
  • A complaint under a scheme's internal dispute resolution procedure: We can also advise on designing and implementing internal procedures that comply with the applicable statutory requirements, providing advice to trustees on the merits of any complaint, assisting with the interaction with employer procedures and obligations as well as assisting members who may have a complaint they wish to raise.
  • Pensions Ombudsman complaints: These can involve broad and ill defined complaints and a lot of paperwork. We can assist our clients to identify the relevant issues and address each of them appropriately, whether as scheme members, trustees or sponsoring employers.
  • Court proceedings: We use our experience and knowledge to assist trustees, employers, members and intermediaries with all aspects of court proceedings and applications whether contentious or consensual.
  • Considering what appeal procedure might be available from an unsatisfactory decision at any of the above stages.
